The Mercator Institute for China Studies (MERICS) is a Berlin-based, independent think tank and leading European provider of policy-oriented research on contemporary China. Founded by Stiftung Mercator, MERICS analyzes current trends in China’s economy, politics, and society and their implications for Europe.

MERICS seeks to fill the following position as soon as possible.

Senior Research Associate – Chinese Law and Governance


Research and analysis

  • Conduct original research on China’s legal system, system of governance and judicial reforms with a strong focus on their implications for business, government and civil society actors in Europe and elsewhere in the world
  • Produce authoritative reports, policy analyses, academic publications and other written products related to core program themes including Chinese policy-making and the interaction between party and state organs
  • Oversee the tracking of the legislative agenda of the National People´s Congress, judicial reforms, and normative documents of the Chinese Communist Party


  • Serve as an expert commentator in the media and engage in public outreach through op-eds, public talks, social media and other outlets
  • Participate in public events and engage in consultative meetings with policy makers and stakeholders


  • Strong academic background in law or public policy, preferably with a China focus (MA/MSc/LLM/PHD)
  • Minimum of 2-4 years of relevant professional work experience (does not include internships)
  • Experience in living in China and/or working on China-related issues
  • Fluent professional English skills, a strong knowledge of modern Chinese (minimally HSK 4 or equivalent); knowledge of or willingness to learn German or at least one other European language an advantage
  • High degree of flexibility and willingness to work as part of a team

Job Description:

  • Provide legal advice and expertise on all applicable topics impacting digitalization within the region.
  • Review, negotiate, manage and maintain all contracts with respect to digitalization matters in the region.
  • Elaboration and implementation of standards with respect to all types of contracts impacting digitalization in the region and with a global approach.
  • Manage legal topics and support other Global Expert Team and regional Law Department members within a special digital field of legal expertise like in Data Privacy, Data
  • Protection, Cyber Security, Cloud computing, Telecommunications, Software as a Service, Big Data, OSS, Business, artificial intelligence, IoT, Social Media, App Development and right to use or E-commerce and On-Demand Platforms and Open Source Software.
  • Understand the legal landscape of a special field of digital expertise in the region and globally and track and report on changes and trends.
  • Selection, supervision and evaluation of external lawyers within the region and in Asia-Pacific countries where the GET Digitalization is not present.
  • Create training templates for digitalization matters and train Continental employees concerning digitalization within the region.
  • Existing corporate procedures and policies impacting digitalization within the region.
  • Participate in regularly meetings to review pending matters, legal trends and changes in “digitalization law” and follow hot topics related to digitalization like autonomous driving etc.
  • Collaborate with other regional Legal Department and Global Expert Team members and their heads worldwide and communicate information, questions, concerns and strategies.
  • Ensure excellence in legal services and counseling of global client base.
  • Improve Continental`s global performance with respect to all digitalization matters.

Ihr Profil

Job Requirements:

  • Bachelor degree from accredited Chinese law school/university and admitted to the Chinese bar, foreign additional education preferred.
  • 10 + years international working experience as an associate/partner in a multinational law firm and/or corporate counsel in a multinational corporation in China and a foreign non-Asian country.
  • 7+ working experience in digital legal matters, e.g. software contracts, Data Compliance, Big Data Business, Cyper Security, Telecommunication, Cloud Computing, XaaS, social media.
  • Working experience in a global team.
  • Persuasiveness, ability to negotiate and draft contracts and effectively communicate legal and non-legal advice in a timely manner.
  • Fluent in written and spoken Mandarin Chinese and English.
  • Enthusiastic, enjoy working hard and being challenged, and demonstrate sound judgment even in ambiguous situations, self-dependent.
  • High level of effective communication, self-reflection, result and customer orientation, team orientation
